01About these Terms
These Terms of Service (the “Terms”) govern your access to and use of dunster.ai and the content and features available on it (the “Site”), which is operated by Dunster Physical AI (“Dunster,” “we,” “us” or “our”). By using the Site, you agree to these Terms and acknowledge our Privacy Policy. If you don’t agree, please don’t use the Site.
The Site is intended for business audiences. It provides information about Dunster, our technology and our products, and lets you rate a robot with our Physical AI Safety Rating (the “Safety rating”), request a demo, book a meeting or contact us.
02Information only
Content on the Site is provided for general information. It isn’t medical, clinical, engineering, legal, financial or other professional advice, and you shouldn’t rely on it as such.
03Products, plans and forward-looking statements
Products, features and capabilities described on the Site may be under development, may change, and may not be available in every market. Some may not have been cleared or approved by the U.S. Food and Drug Administration or other regulatory authorities. Diagrams, animations and illustrations are schematic and not to scale.
Statements about our plans, roadmap, partnerships and expectations are forward-looking. They reflect our current intentions and are subject to risks and uncertainties, so actual results may differ materially.
Nothing on the Site is an offer to sell any product or service. Any pilot, purchase or deployment will be governed by a separate written agreement between you and Dunster.
04No offer of securities
Nothing on the Site is an offer to sell, or a solicitation of an offer to buy, any securities. Any investment discussion is subject to separate documentation and applicable securities laws.
05Third-party references
We cite third-party statistics and research for context, and their accuracy is the responsibility of their original sources. References to universities, hospitals, institutions or other organizations are for identification and information only, and don’t imply that they endorse Dunster or our products.
06Acceptable use
You agree not to:
- use the Site in violation of any law or regulation;
- submit false, misleading or unlawful information, or impersonate any person or organization;
- submit patient information, protected health information or other sensitive personal data through the Site;
- try to gain unauthorized access to the Site or its related systems, or interfere with or disrupt the Site, including by introducing malware;
- use bots, scrapers or other automated means to access or collect information from the Site, other than standard search-engine indexing, or try to bypass our human verification check;
- present a Safety rating as a certification, approval or endorsement by Dunster, or suggest that Dunster has checked or verified it; or
- copy, modify, distribute or create derivative works from the Site, except as these Terms allow.
07Intellectual property
The Site and its content, including text, graphics, designs, diagrams and logos, and the Dunster Physical AI name and marks, are owned by Dunster or its licensors and are protected by intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable and revocable license to view and use the Site for your own informational purposes, including evaluating a potential relationship with Dunster. You may not use our name, logos or other marks without our prior written permission. All rights not expressly granted are reserved.
08Your submissions
When you request a demo, book a meeting, answer the Safety rating’s questions, comment on our Safety Principles draft or contact us, you’re responsible for the information you provide, including your rating answers, and you confirm that you have the right to share it. Please don’t send confidential or proprietary information through the Site. Unless we’ve agreed otherwise in a signed written agreement, such as a nondisclosure agreement, we’re not obligated to keep information you submit through the Site confidential.
If you send us ideas, suggestions or feedback, we may use them without restriction or compensation to you. Our Privacy Policy explains how we handle personal information.
Comments on the Safety Principles draft are reviewed before they appear, and we may decline or remove any comment. By sending one, you let us publish it on the Site with the name and organization you entered, and use it to improve the Safety Principles. Comments must not include patient information, anyone’s confidential material, or content that is unlawful, abusive or infringes anyone’s rights. A published comment is its author’s view, not Dunster’s. The draft is published for comment only: it is not in force, and it isn’t a warranty, certification or promise about any product.
09The Physical AI Safety Rating
The Safety rating at dunster.ai/safety/ asks you questions about a robot and where it works, then generates a rating automatically from the answers you give. We don’t check or verify your answers or any evidence you refer to, so every rating is indicative only.
A Safety rating isn’t a certification, inspection, audit, approval or endorsement of any robot, product or deployment. It isn’t an insurance quote, an offer of insurance or a binder of cover, and it isn’t engineering, legal, safety or other professional advice. Neither you nor anyone else should rely on a Safety rating to make safety, purchase, deployment, insurance or regulatory decisions.
To the fullest extent the law allows, Dunster and its affiliates, officers, employees and agents accept no responsibility or liability for any Safety rating, for the answers you give or any evidence they refer to, or for any decision, loss or claim arising from them.
A Safety rating isn’t a statement, representation, warranty or admission by Dunster about any robot or deployment. You may not present a rating as a Dunster certification, approval or endorsement, and you may not use it as evidence of Dunster’s opinion in any claim or proceeding against Dunster or its affiliates, officers, employees or agents.
You’re responsible for the answers you give, and you confirm that you have the right to share them. We may change the questions or the rating method at any time, so the same answers may lead to a different rating later. We keep a record of each rating and handle it as our Privacy Policy describes.
10Scheduling and third-party services
The Site uses third-party services, including a form-processing service that delivers demo requests, hCaptcha to check that submissions and rating requests come from people, and Calendly for booking meetings, and it links to third-party websites. We don’t control, and aren’t responsible for, those services or websites, and your use of them is subject to their own terms and policies.
Submitting a demo request or booking a meeting doesn’t create an obligation for you or for Dunster to enter into any further agreement.
11Disclaimers
THE SITE AND ALL CONTENT AND FEATURES ON IT, INCLUDING THE SAFETY RATING, EVERY RATING IT PRODUCES AND THE REQUEST A DEMO FORM, ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DON’T WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, THAT ITS CONTENT IS ACCURATE, COMPLETE OR CURRENT, THAT ANY SAFETY RATING IS ACCURATE, COMPLETE OR FIT FOR ANY PURPOSE, OR THAT ANYTHING YOU SUBMIT THROUGH THE REQUEST A DEMO FORM OR THE SAFETY RATING WILL BE DELIVERED, RECEIVED OR ANSWERED.
12Limitation of liability
TO THE FULLEST EXTENT PERMITTED BY LAW, DUNSTER AND ITS AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA OR GOODWILL, ARISING OUT OF OR RELATING TO YOUR USE OF THE SITE, INCLUDING THE SAFETY RATING AND ANY RATING IT PRODUCES, THE ANSWERS YOU GIVE OR ANY EVIDENCE THEY REFER TO, ANYTHING YOU SUBMIT THROUGH THE REQUEST A DEMO FORM, AND ANY DECISION MADE IN RELIANCE ON ANY OF THEM. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SITE, INCLUDING THE SAFETY RATING AND THE REQUEST A DEMO FORM, WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DON’T ALLOW CERTAIN LIMITATIONS OF LIABILITY, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.
13Indemnification
To the extent permitted by law, you agree to indemnify and hold harmless Dunster and its affiliates, officers, employees and agents from any claims, losses, liabilities and expenses, including reasonable attorneys’ fees, arising out of your misuse of the Site or your violation of these Terms.
14Governing law and disputes
These Terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Massachusetts, and you and Dunster consent to the personal jurisdiction of those courts.
15Changes to these Terms
We may update these Terms from time to time. When we do, we’ll post the updated Terms on this page and change the “Last updated” date above. Your continued use of the Site after the changes take effect means you accept the updated Terms.
16General
If any provision of these Terms is found unenforceable, the remaining provisions will stay in effect. Our failure to enforce any provision isn’t a waiver of our right to do so later. These Terms and our Privacy Policy are the entire agreement between you and Dunster about the Site, and they don’t replace any separate written agreement you have with us. You may not assign these Terms without our prior written consent; we may assign them without restriction.
